1. 8 hours ago She is Syracuse, New York
2. No one is stopping her from doing anything, other than herself.
Frankly a father of 4 grown and married children should be giving most assets to his children rather than someone who has been with him for two years.
3. oh yeah, she needs to get a lawyer. tell her to look in the phone book and pick one. if the hubby left no will, she is entitled to everything, not the children. she better do it fast.
4. If wife was listed as the beneficiary, then the insurance money goes straight to her. In Washington state, the case law is very specific in that way.
My wife was married before and went through much grief with the step-children. She gave them what he requested in the will, but the fact was that she really could have left them out in the cold...legally.
5. ny state has something called dower law that should help protect the widow no matter how long they were married. it puts in place a formal for dividing the estate between the wife and children. where in ny is she? some areas have lifeline which can help get her the help she needs and you can call for her and tell them the concerns and needs that she has. also check with the local social services for elder help.
