Getting a divorce?

   
How long does it take to get a divorce? I don't know where he is and I will be doing it on my own. I was told by the court clerk I will pay an ad fee, an ad looking for him, and then I don't know what happens if he shows up or not, if he does it won't be a problem, but I want to be divorced asap because I want to get married. Do you know how long should it take? No kids, no properties, just a plain divorce. Thanks! : )

2. I think it depends on where you live. You file papers with an attorney, put an add in the paper that you are looking for your spouse for a specified amount of time and it states a time limit that he has to contact you. If he does not, than your attorney files with the court and I think it only takes about 30 days from that point. Good luck to you!

From a divorce attorney who's sitting next to me: In order to divorce from a spouse who cannot be located you need to have the petition published in a local newspaper for anywhere from 4 to 6 weeks to satisfy notice requirements. If the spouse does not respond after the statutory time period, your next move would be to seek a default judgment. All in all without any children or assets, it shouldn't take more than 3 months.

4. The length of time for a divorce to be "final" differs state to state. In California it is 6 months, In Virginia it is one year. Of course this is after you suffice the notification time period. Since this is an abandonment, the time might be reduced. Again, depending on your state. I never understood why people do not file for divorce when there is an abandonment involved...

5. Finding him is going to be the hardest part.. Also each state and situation is different.... If you find him and it is uncontested.. in some states it can be done in as little as 24 hours.. It is just a matter of signing the papers... Usually the soonest a divorce can happen is a week... and depending on the judge it can be as long as 6 months!!! If you go to an attorney for your divorce you they can help you with an attempt to locate... if they can't find your husband then the judge will just grant the divorce with out him...
